FAIRBURN FISHINGS PARTNERSHIP CONDITIONS OF LET

1. The Beat.

The Fishing extends from the Junction Stream above the confluence with the River Blackwater down to the Tail of the Kettle Pool. Fishing is on the right bank only, with the exception of the stretch of water lying between the tail of the Rowan Pool and the Head of Tommie's Pool, which is leased to the estate Angling Club for trout fishing only.

2. Access. Access to the river is:

a. Junction Stream, Junction, Boat and Bridge Pools. By track leading from the Marybank to Moy Bridge road along the South side of the field next to the river above Moy Bridge.

b. Teal, Colonel, Moy, Plock, Bend and Rowan Pools. By track to the East of the Balloan Inn (beside the stationary caravan). Please close any gates that are closed - this is to prevent unwanted livestock movement.

c. Tommie's, Aquarium and Kettle Pools. By track to the West of the Orrin Bridge (Fairburn Estate sign on gate). The gate should always be locked when leaving and the padlock locked to the chain around the gate when open (people have a habit of throwing the lock and chain away given the chance).

3. Number of Rods.

Five rods may be fished on the Fairburn Beat. Please read the (attached) rules for the Junction, Boat and Bridge Pools. Only two rods may fish any pool at the same time below the Moy Bridge.

4. Methods of Fishing.

Fly fishing and spinning is permitted from the start of the season, however from 1st May ONLY FLY fishing is permitted. No prawning, shrimping, worming or other illegal methods of fishing are permitted at any time. Salmon and Sea Trout Parr and all Kelts or unclean fish should be returned to the river. (An unclean fish is defined as a Kelt or a hen fish in which the eggs are well developed).

5. Boats.

Boats are located on the Bridge Pool, the Plock Pool and the Kettle Pool. Only Fairburn ghillies may handle the boats, which should normally only be used when conditions dictate. Life preservers are to be worn by all in any boat at all times. The length of rope used on the anchor should be restricted to 25 yards when the opposite bank is being fished, and the boat must be kept moving down after every two casts. After use, ghillies must ensure that the boats are securely moored with oars and securing chains locked. Sufficient slack must be allowed for a significant rise in water level.

6. Fishing Returns.

Fairburn retains accurate fishing records for estate purposes and Statutory Returns to Government Departments. Tenants are therefore requested to inform the ghillies of ALL fish they catch, providing the pool name, breed, weight and fly used.

7. Keys.

Keys for huts and gates may be obtained from the ghillies and must be returned after use.

8. Fishing Protocol.

a. Wading is not permitted across the Medium Filum (or centre) of the River.

b. Boats must not be taken across the Medium Filum.

c. All fishers must keep moving downstream by at least two paces after every two casts.

d. Fishers on the opposite bank must be allowed to fish out a pool, or get well down it, before Tenants commence fishing behind them. Tenants must not start fishing in front of a fisher on the opposite bank at any time. Once a tenant has fished a pool through, they must allow the opposite bank precedence before fishing the pool again.

e. If any difficulty with the opposite bank occurs, tenants must inform the ghillies immediately. If this is not possible for any reason, they should contact Peter Hingston on his mobile (07831-244409).

9. Accidents.

The tenant, sub-tenants, their friends and guests shall in every respect be at his or her own risk during the tenancy. Neither the Estate or its servants or agents are liable for any loss, injury, accident or damage which may arise during the Let and including third parties who might be involved.

10. Head Ghillie.

The Head Ghillie is Derek Mair, whose job it is to provide every assistance he can to Tenants and to ensure that these Conditions of Let are followed.
